TSA Stops Man Boarding Plane with Loaded Gun at NY Stewart Intl Airport

An officer with the Transportation Security Administration (TSA), which was Recognized with Multiple Awards for Excellence in the 2021 ‘ASTORS’ Homeland Security Awards Program, prevented a man from carrying his loaded handgun onto a flight at New York Stewart International Airport on Aug. 24, 2022. The .357 revolver was loaded with five bullets.

The TSA officer spotted the handgun on the checkpoint X-ray machine’s monitor as the man’s belongings entered the X-ray unit, and immediately alerted the New York State Police, who responded to the checkpoint.

The man told officials that he forgot that he had his loaded gun with him, and police allowed the man to leave the airport with his firearm.

It was the third gun that the TSA team has stopped at the airport’s security checkpoint so far this year. The traveler also faces a federal civil penalty for bringing a gun to an airport security checkpoint.

“Claiming that you did not know that you had a loaded gun with you is no excuse,” explained Robert Duffy, TSA’s Federal Security Director for the airport.

“If you own a firearm, you need to know where it is at all times.”

Guns can be transported on a flight if they are unloaded, packed in a locked, hard-sided case, and properly declared to the airline. The airline will be sure that the gun travels with checked baggage in the belly of the plane, never in the cabin of the plane.

Don’t pack your firearm in your carry-on bag.

Bringing a firearm to the security checkpoint may lead to a civil penalty of up to $13,333 or an arrest.

Additionally, replica firearms also are prohibited in carry-on baggage and also must be transported in checked luggage.

At the airport, during the check-in process, a passenger needs to go to the airline ticket counter to declare the firearm, ammunition, and any firearm parts.

Civil penalties for bringing a handgun into a checkpoint can stretch into thousands of dollars, depending on mitigating circumstances.

TSA is responsible for the security of over 23,300 domestic and 2,600 international flights per day.

Among the factors TSA considers when determining the civil penalty amount include whether the firearm was loaded and whether there was accessible ammunition.

Civil penalties apply to travelers with or without concealed gun carry permits because even though an individual may have a concealed carry permit, it does not allow for a firearm to be carried onto an airplane. The complete list of civil penalties is posted online.

Individuals who violate rules regarding traveling with guns will have Trusted Traveler status and TSA PreCheck® expedited screening benefits revoked for a period of time.

TSA has additional traveler information specifically related to the transportation of firearms and ammunition posted on its website. A full summary of TSA’s civil penalties for prohibited items is also available online.

TSA reminds passengers to always know the contents of their carry-on bag before coming to the security checkpoint.

TSA has multiple resources available to passengers to help them determine whether an item is permitted in carry-on baggage, checked baggage, either or neither.

Learn how TSA agents can benefit by the use of two-way radio accessories to effectively handle situations and communicate easier.

Travelers can use the “Can I Bring?” feature on the TSA website or on the free downloadable myTSA app.

Travelers can also Tweet or Message “@AskTSA” if they have a travel question or are unsure if an item is allowed through security in a carry-on bag. Just snap a picture or send a question and get real-time assistance weekdays from 8 a.m. to 8 p.m. and 9 a.m. to 7 p.m. on weekends.

Their mission at TSA is to do everything in their power to make sure you get to your destination safely by keeping dangerous items off planes.

The most common explanation they hear from travelers for prohibited items is “I forgot it was in my bag.”

Don’t be that person. Save yourself some money and embarrassment and thoroughly check your bags for prohibited items before heading to the airport.

  • TSA Administrator David Pekoske was confirmed by the U.S. Senate as the Transportation Security Administration’s seventh administrator in August 2017.

  • He leads a workforce of approximately 60,000 employees, including the Federal Air Marshal Service (FAMS), and is responsible for security operations at nearly 450 airports throughout the United States and shared security for highways, railroads, ports, mass transit systems, and pipelines.

  • Under the Administrator’s leadership, TSA is working continuously to raise the security baseline for both aviation and surface transportation through close partnerships and alliances and a robust homeland security network.

  • While continuing to serve as TSA Administrator, Pekoske also served at the Department of Homeland Security as Acting Secretary from January 20 to February 2, 2021, and as the Senior Official Performing the Duties of Deputy Secretary from April to November 2019 and again from February to June 2021.

  • At the Department, Administrator Pekoske helped lead a unified national effort to ensure the continued security of the United States, coordinating components with missions ranging from prevention and protection to recovery and response.

  • Administrator Pekoske holds a Master of Public Administration degree from Columbia University and a Master of Business Administration degree from the Massachusetts Institute of Technology. He earned his Bachelor of Science degree in ocean engineering from the U.S. Coast Guard Academy.
