As disclosure laws mandate stricter deadlines for reproducing and sharing 911 audio recordings and other evidence, agencies across the public safety and criminal justice continuum are struggling to keep up with requests using current manual processes.
NICE’s e-Request works with NICE’s existing recording solution NICE Inform (which was recognized with the 2020 Platinum ‘ASTORS’ Award for Best 911 Recording & Analytics), to address this challenge, by ensuring timely disclosure of 911 audio evidence through automation.
E-Request digitally transforms how emergency communications centers (ECCs) receive and process 911 audio evidence requests and share incident information with district attorneys, police investigators and other key stakeholders.
Increasingly, disclosure laws, such as New York State’s Article 245 of the Criminal Procedure Law, are requiring prosecutor’s offices to produce discoverable evidence for more cases and share that evidence with defense attorneys sooner.
For example, under Article 245, discovery for non-criminal offenses must be performed as soon as practical, but not later than 15 days before trial.
In criminal cases, prosecutors must hand over discoverable material to defense within 20 days following an arraignment (if a defendant is in custody) and within 35 days (if not).
Non-compliance can put viable cases at risk of being dismissed. Many other states have or are pursuing similar new requirements for the disclosure of evidence to speed the delivery of justice.
These consolidated turnaround times are exerting pressure on upstream 911 centers to respond to evidence requests faster too.
Adding to this workload are growing volumes of Freedom of Information Act (FOIA) requests from the media and citizens, and requests from investigators and defense attorneys as well.
Today’s archaic manual evidence management processes can’t stand up to these new, stricter disclosure requirements.
Fulfilling 911 audio requests consumes critical 911 staff resources and involves many time-wasting manual processes – such as emailing, filling out forms, piecing together data from different systems, sending audio out to be redacted or transcribed, copying evidence onto DVDs or USB drives, culminating in their physical tracking and delivery.
This in turn contributes to long turnaround times for 911 centers, cost over-runs, and duplicate work. Prosecutors struggle with many of these same problems along with the added negative consequence of potential case dismissals.
How E-Request Works
Prosecutors and other requestors submit their requests via E-Request.
Upon receiving the request, ECC personnel simply enter a CAD incident number, and all associated audio and CAD incident data are automatically correlated and assembled together, ready to share with the requestor.
Prosecutors are automatically notified when evidence is ready for downloading via E-Request’s secure browser-based portal.
E-Request also delivers new-found efficiencies to police detectives by enabling trusted users to directly access 911 audio as they work on investigations.
Additionally, with the E-Request mobile app, officers are able to access and listen to 911 calls when they are dispatched to an incident.
E-Request is the latest addition to NICE’s cloud-based Evidencentral platform which digitally transforms the end-to-end criminal justice process, from crime to court.
